The Western Cape York communities co-existence agreement

Under the WCCCA, the Aboriginal Community provides its support for the continuation and expansion of Comalco’s mining and related activities, including support for the grant of any new rights and interests obtained by Comalco in order to support its business. The community also undertakes not to interfere with Comalco’s mining operations.

In particular, the Aboriginal Community agrees:

to do whatever is required to have the WCCCA registered as an ILUA;

that all of Comalco’s rights and interests are valid;

that where there is a conflict between any native title rights and Comalco’s interests and activities, the native title rights must yield;

that native title has been extinguished by earlier grants of SPMPLs and by any new grants of SPMPLs that are made in the Weipa township areas, and that any native title in bauxite and kaolin minerals has been extinguished;

that land in any part of Comalco’s leases can be granted to the Queensland Ports Corporation;

to seek only a particular sort of determination of native title which is supported by Comalco and is in line with the Agreement;

to drop any existing legal actions which they had started against Comalco in the courts and not to start any new court actions;

Not to start off any native title claims which do not comply with the WCCCA;

to the grant of rights over areas within the ILUA which Comalco might need for a gas pipeline to Weipa, subject to the payment of additional compensation to be negotiated between Comalco and the Co-ordinating Committee established under the WCCCA.
